WILL DISPUTE LAWYER - Cut-out / Short Changed

Have you been cut out of the last will & testament of a family member? Has someone been disproportionately awarded an excessive share of the estate of a dead family member? Does a recipient's estate share seem to be the result of their undue influence and proximity to the deceased? Does there appear to be something shady in how the last will & testament came into existence? Or does it replace a more equitable and proportional distribution in an earlier last will & testament?

If you believe that you have been cut out or otherwise shortchanged of your appropriate share in the decedent's estate, you can expect nothing short of a difficult and costly legal battle. For if this particular individual or individuals has manipulated the situation that led to the contentious last will & testament being signed, they aren't necessarily going to admit to their malfeasance and duplicity in forcing through an illegitimate last will & testament. As such this portends of a challenging task to disprove the legitimacy of the testamentary documents and/or that the now dead testator did not have the capacity and/or intent when alive to dispose of his/her estate in the manner set forth in the last will & testament of the decedent.

At the law firm of Neufeld Legal P.C., we understand the challenges of disputing a will that has been submitted to the executor of the estate and provides for an unsatisfactory distribution to yourself, especially where the last will & testament does not appear to coincide with your understanding of what the deceased person had intended. Overturning or modifying the terms of the will can be exceedingly difficult, and extremely costly. The legal battle can be exceedingly arduous and expensive, with no certainty that you will necessarily realize the desired reversal given the evidence that may exist (or the lack of countering evidence), which is the harsh reality associated with challenging a dead individual's last will & testament. Nevertheless, if there has been malfeasance, it should be explored and, if appropriate, aggressivley pursued via estate litigation.
